By booking a rack at CASA Rack, you agree to the following Terms & Conditions.
Definitions
For the purposes of these Terms & Conditions, the following definitions apply:
'Seller' means an individual who rents a rack at Casa Rack to sell their pre-loved clothing, shoes, handbags and accessories. Sellers manage their inventory through the Circle Hand consignor portal and keep ownership of their items until they sell.
'Buyer' means any customer who purchases an item from Casa Rack.
'Rack' means the retail display space rented by a seller for the duration of their booking.
'Consignor portal' means the Circle Hand online platform used by sellers to register, list, price and manage their inventory, sales and payouts.
'Rental period' means the agreed booking period during which a seller's items are displayed for sale in-store.
'Sale proceeds' means the amount received from the sale of an item after Casa Rack's commission and any applicable fees have been deducted.
1. About Casa Rack
Casa Rack is a circular fashion boutique where individuals can rent a rack to sell their pre-loved clothing, shoes, handbags and accessories.
Casa Rack acts solely as a facilitator of sales between sellers and buyers. Ownership of all items remains with the seller until they are sold.
2. Seller eligibility
To book a rack, sellers must:
- Be 18 years of age or older.
- Provide accurate personal and payment information.
- Agree to all Casa Rack policies and procedures.
Casa Rack reserves the right to refuse or cancel a booking at its discretion.
3. Rack booking
- A rack booking period is for two (2) weeks, equivalent to ten (10) trading days.
- The cost of booking one rack is AUD $198
- Rack booking fees must be paid in full at the time of reservation.
- Booking fees are non-refundable unless otherwise agreed by Casa Rack.
- Two sellers may share a rack and split the booking cost.
However, both sellers remain jointly responsible for complying with these terms & conditions.
4. Accepted items
We accept:
- Women's clothing
- Shoes
- Handbags
- Fashion accessories
All items must:
- Be clean and freshly laundered.
- Be in excellent condition.
- Be free from stains, odours, excessive wear or damage.
- Be suitable for resale.
- Reflect the quality and aesthetic standards of Casa Rack.
Casa Rack reserves the right to refuse or remove any item that does not meet these standards.
5. Prohibited items
The following items are not permitted:
- Counterfeit or replica goods
- Stolen goods
- Underwear
- Swimwear without hygiene protection
- Damaged or unsafe items
- Illegal or prohibited products
Any prohibited items may be removed immediately without notice. Where appropriate, Casa Rack may report suspected counterfeit or stolen goods to the relevant authorities.
6. Seller responsibilities
Sellers are responsible for:
- Creating and maintaining an accurate item listing in the Circle Hand consignor portal.
- Pricing their items.
- Attaching the labels and barcodes supplied by Casa Rack.
- Merchandising and maintaining the presentation of their rack.
- Collect all unsold items at the end of their rental period.
Casa Rack provides hangers for all racks.
7. Rack capacity
There is no strict limit on the number of items you may bring. However, we recommend approximately forty-five (45) items per rack to create an attractive and easy-to-shop display.
Shoes, handbags and accessories are welcome, provided the display remains neat and organised.
Casa Rack reserves the right to request the removal of excess items if a rack becomes overcrowded.
8. Rack set-up
Sellers are responsible for setting up their rack on the first day of their booking between 8:00 am and 9:30 am.
If you have not arrived within forty-eight (48) hours of your booking start date and have not contacted Casa Rack, your booking may be cancelled without refund.
9. Restocking
You may restock your rack as often as you wish during your rental period.
Before adding new items, they must:
- Be entered into your consignor account.
- Have the correct label and barcode attached.
10. Sales commission
Casa Rack retains a commission of 15% on all items sold.
This commission will be deducted from the sale proceeds before your payout is processed.
11. Payouts
Your earnings will be transferred to your nominated bank account within seven (7) business days after your rental period ends.
Casa Rack is not responsible for delays caused by incorrect banking details supplied by the seller.
12. Automatic markdowns
To help maximise sales, all racks will automatically receive a 25% discount during the final four (4) trading days of the rental period (Tuesday to Friday).
If you would prefer not to participate or would like a different markdown percentage, please notify Casa Rack by email before the markdown period begins.
13. Lost, stolen or damaged items
While Casa Rack takes reasonable care of all items, all goods remain in the store entirely at the seller's own risk.
Casa Rack is not responsible for:
- Theft
- Loss
- Misplaced items
- Damage caused by customer handling or fitting
- Normal wear and tear during the rental period
Please do not consign items you cannot afford to lose.
14. Returns and exchanges
Returns and exchanges are managed in accordance with Australian Consumer Law and Casa Rack's Buyer Policy.
15. Authenticity
Sellers are solely responsible for ensuring that all items offered for sale are genuine.
Casa Rack does not authenticate designer goods and accepts no responsibility for claims relating to authenticity.
16. Rack presentation
To maintain a premium shopping experience, Casa Rack reserves the right to remove any item or display that is:
- Dirty
- Damaged
- Poorly presented
- Unsuitable for the store
- Overcrowded
17. End of rental period
All unsold items must be collected on the final Friday of the rental period between 4:00 pm and 5:00 pm.
If you are unable to collect your items, Casa Rack can pack down your rack for a service fee of AUD $25, which will be deducted from your payout.
Items left uncollected for more than five (5) days after the collection date may become the property of Casa Rack and may be donated, resold or otherwise disposed of at our discretion.
18. Seller conduct
Sellers are expected to treat staff, customers and other sellers with courtesy and respect.
Casa Rack reserves the right to terminate a seller agreement if these Terms & Conditions are breached or if inappropriate behaviour occurs.
19. Limitation of liability
To the maximum extent permitted by Australian law, Casa Rack is not liable for any indirect, incidental or consequential loss arising from participation in the rack rental program.
Nothing in these Terms & Conditions excludes or limits any rights you may have under Australian Consumer Law.
20. Changes to these Terms
Casa Rack may update these Terms & Conditions from time to time.
The latest version will always be available on our website, and continued participation in the rental program constitutes acceptance of any updated terms.
